License Agreement

This License Agreement is a legal agreement between You (either an individual or a single entity) and 2LM Sp. z o.o., a Polish privately held company for the purchased software product, including any software, media, and accompanying on-line or printed documentation (“Product”).

BY PURCHASING, DOWNLOADING, INSTALLING, COPYING OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.

The Software is licensed to You for use only under the terms and conditions of the License. It presupposes that You acknowledge that all intellectual property rights, copyrights and trademarks of the product belong to 2LM Sp. z o.o.

GRANT OF LICENSE

Provided that You comply with all terms and conditions of this agreement, 2LM Sp. z o.o. grants You a non‑exclusive license to install, download and use a single instance of the Product through a single installation (one computer). Up to 1 additional test installation is permitted per licence. Additional copies of the Product may be installed and used, up to the number of “Licensed Copies” purchased.

You may make copies of the Product for backup and archival purposes.

All copies of the Product must contain the same proprietary notices that appear on and in the license, including all copyright notices, which must remain unaltered from the original version, unless by specific prior arrangement with 2LM Sp. z o.o. has been made.

2LM Sp. z o.o. reserves the right to gather data on key usage, including license key numbers, server IP addresses and other information deemed relevant, to ensure that our products are being used in accordance with the terms of this License Agreement.

2LM Sp. z o.o. reserves all rights not expressly granted to You in this agreement.

RESTRICTIONS

Unless You have been granted prior, written consent from 2LM Sp. z o.o., You may not:

  • reproduce, distribute, or transfer the Product, or portions thereof, to any third party, on temporary or permanent basis, without the prior written consent of 2LM Sp. z o.o.,
  • sell, rent, lease, assign, or sublet the Product or portions thereof,
  • grant rights to any other person.

For violation of our policy, license keys will be disabled and users’ accounts – blocked.

NOTE: 2LM Sp. z o.o. doesn’t support any form of software piracy.

DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, 2LM SP. Z O.O. DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.
THE PRODUCT IS INTENDED TO MANAGE ONLY DEFAULT DATABASE AND MAY NOT BE COMPATIBLE WITH OTHER EXTENSIONS, CUSTOMIZATION OR OTHER INTEGRATION OF THIRD PARTY COMPANIES.

SOFTWARE ADD-ONS

Each product license is issued based on domain, where it will be used. If You need this product working on additional domains, You need to purchase separate licenses.

Add-ons, plugins and extensions are separate software products and each of them requires a separate license key.

SUPPORT AND UPDATE SERVICES

After the purchase, the customer receives 6 months of free update and support service, which means that during that period, the download link to the application and/or the latest version of the product will be available for the owner of the license. Product updates (downloads) after that date are issued for additional fee.

2LM Sp. z o.o. reserves the right to keep only updates (files) released within last year. Older updates may not be available for download.

Accepting the license policy, customer agrees not to retrieve updates in any possible way except for ordering update service. In case, when some attempts to get the updates in some inappropriate way were made by the customer, 2LM Sp. z o.o. reserves the right to stop providing support and disable all product licenses developed by our company until the full cost of the update service is paid back.

2LM Sp. z o.o. is not obliged to provide You with any updates that were not released for general distribution.

REFUNDS

2LM Sp. z o.o. provides refund on the Product within 30 days of purchase for exceptional cases only:

  • agreement terms violation by licensor,
  • any considerable reason that can be negotiated.

Refund may not be considered other way.

DISCOUNTS

Discounts are issued in the form of “percentage off” and are offered to customers via promotional emails, advertisements, on-site banners or 3rd party communications. You can use one discount code per one order. Unless otherwise stated, discounts are only applicable to full price items (bundles are not included). Discount codes may have validity period or may be issued for a specific product list. 2LM Sp. z o.o. reserves the right to cancel or change any discount without notice, at any time.

PRODUCT DELIVERY

All 2LM Sp. z o.o. products, documentation and related materials are delivered electronically, over the Internet.

INSTALLATION / UN-INSTALLATION / CONFIGURATION

Installation/un-installation/configuration service is available for additional fee.

Remote desktop assistance is provided for additional fee only. The cost is calculated basing on time that our employee spends during the session and this service is non-refundable.

LIFECYCLE POLICY

2LM Sp. z o.o. Lifecycle Policy outlines the product support guidelines for a product's lifecycle. The objective of this policy is to standardize and normalize product lifecycle practices, thereby enabling 2LM Sp. z o.o. customers to make more informed purchase, support and upgrade decisions.

2LM Sp. z o.o. is committed to providing support for all software products for a minimum of two (2) years, starting from the general availability date of the product's major version. “General availability date” is defined as the date on which a product is officially made available for purchase.

The sunset of a product (“End-of-Life”) is the term used to describe the end of support for the product. That is, 2LM Sp. z o.o. or a Third Party vendor will no longer provide new features, improvements, or technical assistance for that release of the product.

End-of-Life will be announced as a part of regular News publication on shop.2lm.pl e-store.

LIMITATION OF LIABILITY

In no event will 2LM Sp. z o.o. be liable for any lost revenue, profit or data, indirect, incidental, consequential damages, even if 2LM Sp. z o.o. shall have been informed of the possibility of such damages, or for any claim by any other party.

SUITABILITY

The persons or company using this Product are solely responsible for thoroughly testing it to make sure it works to their satisfaction before purchasing a license and/or incorporating it into their web site. By obtaining a license, the licensee indicates that the Product has met his/her expectations and runs to his/her satisfaction.

TERMINATION

This Agreement shall continue in effect until terminated. Without prejudice to any other rights, this Agreement will terminate automatically if You fail to comply with any of the limitations or other requirements described herein.
